Terms of sale

Preamble

These General Terms and Conditions of Sale (“T&Cs”) apply to all orders placed on the websites www.mabouledecouches.fr, www.mabouledecouches.com, and www.mabouledecouches.de (“the Website”).

They form the contract between:

And any natural or legal person wishing to make a purchase via the Website (“the Buyer” or “the Customer”).

The Customer acknowledges having read and accepted these T&Cs without reservation before placing an order.

1. Purpose and scope

These T&Cs define the rights and obligations of both parties for online sales of products offered by Ma Boule De Couches®.
They apply to all Customers, both consumers and professionals, in compliance with applicable consumer protection laws.

2. Duration and amendments

The T&Cs are valid from 01/05/2024 and may be updated at any time.
The applicable version is the one in force on the date of the order.
Products purchased are for personal use only and may not be resold or redistributed.

3. Product availability

Products and prices remain valid while visible on the Website, within the limit of available stock.
If an item becomes unavailable after an order is placed, the Customer will be notified by e-mail and may request either a refund (within 14 days) or a replacement.
Real-time availability is not guaranteed for items depending on supplier stock.

4. Prices

Prices are shown in euros and VAT is not applicable (French micro-enterprise regime).
Shipping costs are added at checkout and shown before confirmation.
For deliveries within the EU or UK: no additional customs duties are charged.
For deliveries outside the EU/UK: Customers are responsible for import duties, local taxes, and customs clearance.

5. Orders and payment

Payment is due immediately upon ordering.
Accepted payment methods: bank card (SSL secured), PayPal.
Bank details are never processed or stored by the Website.
Ma Boule De Couches® reserves the right to cancel any order in case of suspected fraud, payment refusal, ongoing dispute, or manifest error (e.g. pricing).
An order is confirmed only once a confirmation e-mail has been sent. Invoices are generated automatically.

6. Delivery

Orders are shipped to the address provided at checkout.
Processing takes an average of 48 business hours, plus carrier delivery times, and will not exceed 30 days.
If the 30-day legal limit is exceeded without justification, the Customer may cancel the order and request a refund.
Full shipping conditions and rates are detailed in the Shipping Policy.
Damaged or missing items must be reported within 5 business days.

7. Right of withdrawal

In line with UK and EU consumer rights, Customers have 14 days from receipt of their order to exercise the right of withdrawal.
Products must be returned complete, unused, and in original condition.
Return costs are borne by the Customer, unless the error is attributable to Ma Boule De Couches®.
For hygiene reasons, washable textile products (diapers, inserts, accessories) that have been used, washed, or tried on cannot be returned.
Refunds are processed within 14 days of receipt of the return.

8. Warranties

Products are covered by the legal guarantee of conformity (2 years) and protection against hidden defects.
Ma Boule De Couches® cannot be held liable for misuse of products or non-compliance with care instructions.
Products comply with French and EU legislation. Customers are responsible for checking compliance with their local laws.

9. Retention of ownership

Products remain the property of Ma Boule De Couches® until full payment has been received.

10. Intellectual property

All Website content (texts, images, videos, logos, graphics, design, etc.) is protected by copyright.
It is the exclusive property of Ma Boule De Couches®.
The brand Ma Boule De Couches® is registered with the French trademark office (INPI). Any reproduction or use without authorization is strictly prohibited.

11. Personal data and record keeping

Data collected is necessary to process orders and manage the customer relationship.
It is handled in accordance with GDPR and our Privacy Policy, available on the Website.
Invoices and contractual data are archived for 10 years.

12. Governing law and disputes

These T&Cs are governed by French law.
In case of dispute, an amicable solution will be sought first.

If no resolution is reached, disputes will be submitted to the competent French courts.
UK Customers may also seek free assistance through the European Consumer Centre (ECC UK) for cross-border disputes.
